These Terms and Conditions govern the sale of products by ACTIV8 KARBON PRIVATE LIMITED. By purchasing from us, you agree to the terms outlined below. Please read them carefully before proceeding with any transaction.

1. Payment Terms

  • • 100% Advance Payment : All orders require full payment in advance. No product will be dispatched until payment is received and confirmed. Failure to make full payment will result in order delays or cancellation.
  • • Payment Variability: While specific payment terms may vary between customers based on prior agreements,100% advance payment is required in all cases.

2. Delivery and Shipping

  • • No Delivery Before Payment:Products will only be dispatched once payment has been fully cleared. No partial payments or post-payment shipping arrangements are accepted.
  • • Delivery Timeline: Delivery schedules are provided for reference and may be subject to delays due to external factors such as logistics or availability of shipping services.
  • • Non-returnable Bags: Once the product is delivered, the packaging (bags, boxes, etc.) is non-returnable. Customers are advised to dispose of these items responsibly.

3. Product Quality and Replacement

  • • Guaranteed Product Quality: We guarantee the quality of our activated carbon products as per the agreed specifications and grade for the intended application.
  • • Quality Assurance: If there is any deviation from the agreed-upon product quality, we will replace the product at no additional cost however logistics and labour will be charged. Any quality claims must be substantiated by supporting evidence such as product testing or certifications.

4. Non-liability for Product Performance

  • • No Performance Warranty: Our responsibility is limited to providing products according to the agreed specifications and grade. We do not guarantee specific performance outcomes in your processes or applications. This includes, but is not limited to, product performance in water treatment, air purification, or industrial uses.
  • • No Responsibility for Misuse: We are not liable for any failure of the product due to improper storage, incorrect usage, or deviations from the recommended application.
  • • Non-working Products: If the product is delivered as per the grade and application specified, but it does not perform as expected in your system or process, we are not liable for exchanges or refunds. In such cases, exchanges can only be made at an additional cost.

5. Limitations on Liability

  • • Indirect Losses: ACTIV8 KARBON PRIVATE LIMITED shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to losses due to process inefficiencies, equipment failure, or production downtime arising from the use of our products.
  • • Third-Party Equipment: We are not liable for damages caused by or to third-party equipment or systems where our activated carbon is used. It is the customer’s responsibility to ensure the compatibility and suitability of our products with their systems.
  • • No Responsibility for Environmental or Regulatory Compliance: We are not liable for any customer failure to meet environmental or regulatory standards when using our products. It is the customer’s responsibility to ensure compliance with local and international regulations in their respective industry.
  • • Non-advisory Role: While we may offer product recommendations based on industry knowledge; we are not responsible for the final decision on product selection. Customers must conduct their own due diligence and testing to ensure the product meets their specific needs and regulatory requirements.

6. Customer Obligations

  • • Accurate Information: The customer is responsible for providing accurate product specifications, grades, and intended applications at the time of ordering. Any misrepresentation or lack of clarity may result in product mismatches for which ACTIV8 KARBON PRIVATE LIMITED will not be held liable.
  • • Proper Storage and Handling: Once products are delivered, the customer is solely responsible for proper storage and handling. Damage resulting from improper storage (such as exposure to moisture or contamination) voids any claims for replacement or compensation.

7. Exchanges and Returns

  • • Faulty Product Replacement: If the product is faulty or does not meet the agreed-upon quality, we will replace the product at no extra charge, provided sufficient evidence supports the claim.
  • • No Returns for Correctly Delivered Products: : If a product is delivered according to the agreed specifications and is found not suitable due to factors outside of our control (e.g., misapplication, incorrect usage), we will not accept returns or exchanges. Any product exchange in such cases will only be provided at additional cost.

8. Order Cancellations and Modifications

  • • No Cancellations After Payment: Once an order is confirmed and payment has been made, it cannot be cancelled unless explicitly agreed upon by both parties. Modifications to product specifications after payment will incur additional charges.

9. Force Majeure

ACTIV8 KARBON PRIVATE LIMITED shall not be held liable for any failure or delay in delivering products due to events beyond our control, including but not limited to natural disasters, transportation disruptions, strikes, governmental actions, or shortages in raw materials.

11. Indemnification

The customer agrees to indemnify and hold ACTIV8 KARBON PRIVATE LIMITED harmless from any claims, damages, losses, or liabilities arising from their improper use of the product, failure to follow recommended guidelines, or non-compliance with applicable regulations.

12. Changes to Terms and Conditions

We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be posted on our website, and continued use of our products and services will constitute acceptance of the modified terms.
